Voyager Info-Systems Voyager General User Agreement
This is a legal agreement ("Agreement") between you and Voyager
Info-Systems ("Voyager"). In return for your usage of the services provided by
Voyager, including but not limited to VoyUsers (users.voyager.com)
and VoyForums (www.voy.com). By using these services, viewing or transmitting
any data to or from VoyForums, or creating an account on any of these services,
you and Voyager agree to all the terms and conditions herein. "Sites" and "services"
are used interchangably to represent Voyager's systems, websites, and software, and
services provided by Voyager, and "users" refers to anyone accessing these sites or
services through any means, whether receiving or transmitting data.
- You will keep your e-mail address updated. Voyager does not sell its private
user data, so please keep your e-mail address updated and accurate. Accounts
with invalid e-mail addresses are subject to termination.
- You will not spam. Mass postings and broadcasting of data not only annoys
users, it also wastes our time and causes extra load on our systems. As such,
it is considered an attack on our system, and because of its nature, we consider
it a DoS (Denial of Service) attack, and is an illegal offense. You will neither
participate in such activities, nor promote them, and anyone found involved in
the production of software or devices for such activities may also be subject
to legal action. We do not take this lightly -- Voyager's
services are not to be used for spamming, mass-postings, or the
broadcasting of messages by any method without the express written approval of
Voyager Info-Systems.
- You will not stalk or harass users of our system, nor will nor will you
post, email, or otherwise transmit any data which is illegal, harassing,
threatening, abusive, or obscene to our system nor any user of our system.
Also included as such an activity is the display of any private information
of an individual, company, or other organization without permission of that
individual, company, or organization.
- Voyager reserves the right to suspend or terminate without notice your
access to any of our services and/or your account(s) at
Voyager's sole discretion. The right to delete an account or refuse
service to any individual includes but is not limited to the reasons
specified in this agreement. Voyager is not obligated to provide
a refund in the case of account suspension or termination.
- You will not engage in unsolicited advertising to other
members or users of Voyager's services to buy or sell any products or services.
- You may not include advertisements, banners, or images on your message
board for purposes of advertising anything other than your own product or
service if your message board is dedicated to your specific product or service.
- You will not pose or pretend to be an officer or staff of Voyager, nor affiliated
with its operations in any way without explicit prior written consent from Voyager.
This consent is a tolerance for cases where Voyager grants duties to users or
volunteers.
- Voyager cannot guarantee the proper functioning or availability of any of
its services or options, including the possibility of a complete
innavailability of the service. You will not hold us liable for any loss
or damages resulting from the use or malfunction of the message board service.
- Voyager provides the VoyForums message board service on an "as is" basis
and Voyager grants no warranties neither express, implied, nor statutory
with regards to its services nor with communication to Voyager or its
representatives or employees. Specifically, Voyager disclaims any
warranties of merchantibility, fitness for a particular purpose, or
noninfringement. Voyager does not warrant that any of its services will be
available, nor that they will be error-free or secure, nor that it will
meet your requirements. Additionally Voyager makes no claims that defects
or errors will be corrected.
- You agree to defend, indemnify, and hold harmless Voyager, its officers,
directors, employees, agents, or third parties in the case of any loss or
damages, either direct, incidental, or consequential (including but not
limited to damages in loss of data, loss of programs, or cost of
procurement of substitute services or service interruptions), even if these
damages arise out of the use or inability to use Voyager's services even
if Voyager or its agents, representatives, or employees have been advised
or notified of the possibility or occurance of such damages.
- You understand that Voyager cannot be held liable for any acts or omissions
of other members or users including unauthorized users, members, or
hackers.
- The content of message boards, including, but not limited to, any
opinions, advice, statements, or offers made available on any of Voyager's
services are are those of their respective authors and not of Voyager and
should not necessarily be relied upon. The authors are solely responsible
for such content and Voyager does not guarantee nor is Voyager responsible
for the accuracy, usefulness, or completeness of any information on the
service nor does Voyager endorse any of such content. Under no
circumnstances will Voyager be responsible for any loss or damage resulting
from anyone's reliance on content or information made available via
Voyager's services nor information transmitted to members or users of Voyager's
services.
- Additionally, Voyager reserves the right, but has no obligation, to monitor
the materials posted or otherwise made available on Voyager's services or
pertaining to Voyager's services including sites related to members of
Voyager Info-Systems and/or its services and users of the services
including but not limited to posts made on Voyager sites and private messages
between users of Voyager's sites. It is also understood that users may
supply to Voyager content provided to them by other users. It
is understood that the monitoring of all such information is necessary for
multiple reasons including but not limited to the need for Voyager to be
aware of the content available via its services, the information transmitted
as a result of content available via its services, maintaining the quality of
service, and monitoring its services for bugs or errors in Voyager's
software or content.
- Furthermore, Voyager reserves the right, but has no obligation, to remove or
add any material it wishes at any point in time, specifically but not
limited to removing material that violates, or is alleged to violate, the law or
this agreement. Notwithstanding this right of Voyager, you and other users
of Voyager's services remain solely responsible for the content of the material or
information you make available through Voyager's services, or your private e-mail messages.
- *IMPORTANT: It is possible that members or users, including
unauthorized users or hackers, may post, transmit, or make available
offensive or obscene materials on or via Voyager's services and you may be exposed
to such materials. Additionally it is possible for your personal information
to be accessed by such users and used to harass or injure you. Voyager is not
responsible for the use of any personal information that you may choose to
disclose on or to Voyager's sites or services. Please carefully choose the
information and type of information you make available via these sites or
release to others.
- Voyager owns and retains all rights to information it makes available via
its services including but not limited to proprietary posts made by Voyager
employees, any and all proprietary graphics and data otherwise made
available, and any and all copyrighted material, trademarks, and all other
proprietary information of Voyager and its licensors. Additionally, Voyager's
members or users may post copyrighted information and trademarks whether or
not they are clearly identified or indicated as such and, except for that
information which is in the public domain or of which you have been given
permission, you will not copy, modify, publish, transmit, distribute, perform,
display, or sell any such proprietary information.
- By posting information or content to any public area of Voyager's services you
are at risk of this information being copied or used in a manner you do not
wish. It is your responsibility to consider the type of information you
wish to make available and, if your rights are violated by another
Voyager member or user, you are solely responsible for handling the
matter and you understand that Voyager will not be involved with such
issues.
- Certain jurisdictions limit the applicability of warranty disclaimers and
limitations of liability so the above disclaimers of warranty and limitations
of liability may not apply to you.
- This Agreement is entered into in Beverly Hills, California. You
agree that California state law (regardless of conflicts of law principles)
shall govern this Agreement, and that any dispute arising out of or relating
to this Agreement shall be subject to the federal and state courts in Beverly
Hills, California. This Agreement, accepted upon signing up for Voyager's
services, contains the entire agreement between you and Voyager regarding
the use of the service and your conduct, but understand that it is not wholly
inclusive of Voyager's own policy.
- This Agreement may be modified or amended at any time by Voyager, but will
always be available for viewing on the VoyUsers website. This
Agreement may not be modified or amended by you without official authorization by
Voyager and the subsequent written approval from Voyager of the final
agreement. Unless otherwise explicitly stated, the Terms will survive
termination of your membership to any of Voyager's services. If any provision of
this Agreement is held invalid, the remainder of this Agreement shall continue in
full force and effect.
- Should you at any time transfer your consideration in this contract to
another entity, including but not limited to any other individual, company,
corporation, or organization, the new entity must agree to all terms of the
most recent revision of this agreement which will be available on the VoyUsers
website, and possibly on Voyager Info-Systems' homepage, for the duration of
VoyUsers' services.
